We have a strict policy of no pets in any of our Motorhomes without prior agreement in writing, We do not accept all male or all female groups for example stag or hen parties unless by prior arrangement in writing, We do not allow any of our Motorhomes at any Music festivals such as Latitude, T In The Park, Reading, Glastonbury, Rock Ness etc, or Sports events F1 Silverstone, Moto X etc, unless by prior arrangement in writing.
‘Flegg Motorhome Hire’ means Flegg Motorhome Hire
‘Hirer’ means the person(s) named as the hirer under the heading Hirer’s Name on the signed Rental Agreement.
“Driver” means the person(s) nominated as named driver(s) on the signed Rental Agreement.
‘Hire Period’ means the period as stated on the Rental Agreement or any agreed variation thereof (verbally or otherwise) and any additional period during which the vehicle is in the hirer’s possession or control.
‘Motorhome’ means the vehicle as stated on the Rental Agreement and includes tyres, tools, accessories, the living equipment and any other motorhome equipment, any extra hired equipment, documents related to the motorhome and any replacement or substitute motorhome which may be provided by Flegg Motorhome Hire.
‘Rental Agreement’ means the document read and signed by the hirer/drivers on collection and return of the motorhome. It includes details of the Hirer, drivers, motorhome details, rental period, Collection Damage Report and Departure Checklist.
‘Security Damage Deposit’ (SDD) means the money held as security by Flegg Motorhome Hire in relation to this hire. This is payable by bank transfer and cash payments are not acceptable. Flegg Motorhome Hire will refund the SDD within three working days of the date the motor home is returned back to Flegg Motorhome Hire if the motorhome is returned on time and without damage. The Hirer will be responsible for costs should damages not covered by the comprehensive insurance policy exceed the SDD.
The SDD is £500 for drivers 25-79 years of ages, £750 for drivers aged 23 and 24, £1000 for drivers aged 21 and 22 and £1,000 for drivers aged 76 to 79.
In the event of any discrepancy between these Terms and Conditions and any other Flegg Motorhome Hire literature, the provisions of these Terms and Conditions apply.
The motorhome and its contents remain the property of Simon Stubbs trading as Flegg Motorhome Hire at all times.
The hirer is required to keep the vehicle securely locked at all times when it is left unattended, and to refrain from any action or omission which may prejudice Flegg Motorhome Hire’s rights to the vehicle.
The following are strictly prohibited in our Motorhomes, Flegg Motorhome Hire reserves the right to retain in part or whole the security deposit if additional deep cleaning or repair is required upon return of the vehicle due to:
- Any other animals
Flegg Motorhome Hire reserves the right to vary rates and conditions at any time.
Flegg Motorhome Hire offer free car parking for your car whilst you are away, however, vehicles are left entirely at the Owners Risk. Only one allocated parking space is provided per Motorhome hire, with additional vehicle parking available at an additional charge; prices available on request.
The hirer acknowledges delivery of the vehicle and it’s contents, free from defects or damage, other than as specified by Flegg Motorhome Hire.
Before the commencement of hire the hirer is advised to check the vehicle thoroughly before leaving the premises of Flegg Motorhome Hire.
The vehicle must be returned in the same condition as when hired, with the interior and appliances clean.
Flegg Motorhome Hire will charge a cleaning fee of £100 if the vehicle is not returned with the interior in a clean condition.
An additional fee of £50 will be charged if the toilet is not returned empty and flushed through. An additional charge of £20 if the grey waste tank not empty and flushed through prior to the return of the vehicle.
Fuel, Oil & Gas
A full tank of fuel is supplied with the vehicle at the commencement of hire and the hirer is expected to return the vehicle with a full tank of fuel.
There will be a surcharge of £100 plus the cost of fuel for any fuel shortage.
The hirer will be liable if incorrect fuel type is used.
The hirer will be responsible for the regular checking of oil and water levels, and the use of the correct type of fluids.
Flegg Motorhome Hire has the right to refuse to handover the Motorhome on arrival of the hirer to any person who in our opinion is not suitable to take charge of the vehicle, due any concerns we have for the safety of the vehicle or its occupants or other road users, In this situation all monies paid to us will be refunded in full immediately, Flegg Motorhome Hire will have no obligation whatsoever with regard to refunding any monies paid for campsites booked , events booked, travel booked, or any other circumstances.
It is against the law to smoke in all hire vehicles. A fixed penalty of £120 will be imposed if customers are found to have been smoking in our Motorhome. Or a maximum fine of the full Damage Deposit could be imposed if damage is caused by smoking.
1.1 BOOKINGS: There is a £250 reservation deposit payable to secure a booking, this will be deducted from the total hire charge. This is a non-returnable charge in event of cancellation by the hirer. The balance to be paid in full by the hirer three weeks prior to commencement of the hire period. If the booking is made less than three weeks prior to the start of the hire the reservation must be paid Flegg Motorhome Hire in full by means of bank transfer. Motorhomes will not be released without full payment being received.
2. WHAT IS INCLUDED IN THE RENTAL FEE: Unlimited mileage, Fully Comprehensive Insurance for UK license holders for one named driver. There is a £30 fee for one additional driver who must also provide all documents as stated under 4. HIRER / DRIVERS. Full Breakdown & Roadside Assistance (UK), kitchen equipment, fire extinguisher and first aid kit (to be replaced if opened), TV/DVD player, wind out awning, fresh water hose and electric hook up cable. The hirer will be responsible for any call out charges necessitated by the hirer due to operator error, i.e. wrong fuel, windscreen damage, wing mirror, flat battery, tyre damage, lost keys.
Additional insurance loadings may occur for some drivers, i.e. non-UK driving license holders and “high risk” occupations (see below 6. INSURANCE), these charges will be passed on to the hirer.
The motorhome will commence hire with a full tank of diesel fuel. The hirer must return the motorhome with a full tank of diesel fuel (this means full to the top and not just enough to get the fuel gauge to “full”). Failure to do this can result in a charge of up to £100.
The customer will be provided with one full and one partly full cylinder of gas. The vehicle must be returned with one full and one partly full cylinder of gas.
3. HIRE CHARGES
Rental is charged on a per night basis. There is a minimum rental period depending on the season.
Charges apply for late returns at £50 per hour. Variation of collection and return times are available by prior agreement. Collection and return location is to be to Flegg Motorhome Hire Premises. There is no refund for late pick up or early return.
4. HIRER / DRIVERS
The hirer must produce photographic proof of identity such as passport/driving license plus proof of address as below.
Documentation to retain from all drivers:
- Copy of both sides of the photo card drivers’ license (Address & ID must be up to date).
- Online license check – https://www.viewdrivingrecord.service.gov.uk/driving-record/licence-number
- Two forms of proof of address, (address must match the driver’s license)
- Cleared a traceable security deposit (BACS) paid from an account in the drivers name.
- Signed Rental Agreement
The following documentation is acceptable for proof of address alongside One Utility Bill/Statement: (Must be dated within 60 days of the hire date)
Council tax bill/statement
Credit card bill
- All drivers must have held a full UK or EU license for a minimum of 24 months
- All drivers must be aged between 21-79
- Drivers can have up to 6 penalty points on their license (providing they are two minor offences)
- Drivers can have no more than one fault or non-fault claim within a 3 -year period
- Drivers must not have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle. Spent convictions covered by the Rehabilitation of Offenders Act 1974 may be disregarded.
- Drivers must not have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer.
- Drivers must not be engaged wholly or partly in professional entertainment or professional sports persons.
- Drivers must not be Jockeys and persons connected with racing, gaming industry or press of any sort.
- Drivers must not be Undergraduates and/or students under 25 years of age.
- Drivers must not be Foreign Service Personnel other than persons holding a full UK/EU licence for two years or more.
Motorhomes will not be released without valid personal identification. The motorhome will not be released until the SDD is paid by bank transfer. Cash payment is not accepted.
Flegg Motorhome Hire may not be able to get cover for any driver with more than 6 points on the license. Please contact Flegg Motorhome Hire to verify if cover can be arranged.
Drivers are personally liable for all legal penalties (e.g. parking tickets, congestion charges, speeding fines) which are incurred during the period of hire.
5. COLLECTION AND RETURN
Collection and return of the vehicle will be from and to the premises of Flegg Motorhome Hire unless otherwise arranged and agreed on booking.
Collection: Time to be arranged by and with Flegg Motorhome Hire. Please allow 1 hour for the hand-over to complete the documentation and for us to demonstrate your motorhome to you. The hirer can park one vehicle on Flegg Motorhome Hire. Cars and any belongings left inside the vehicle are left entirely at the owner’s risk and Flegg Motorhome Hire cannot take any responsibility for loss or damage.
Return: Time to be arranged by and with Flegg Motorhome Hire. Please allow 45 minutes for handover. Your cooperation in returning the vehicle is essential in order that the vehicle will be cleaned and available for the next hirer. The vehicle must be returned on the date, and at the time stated, on the rental agreement. There are no refunds for early returns. Vehicles must be returned clean and in the same condition as they left Flegg Motorhome Hire, otherwise a charge will be made for excessive valeting and/or upholstery cleaning. In the case of gross negligence Flegg Motorhome Hire reserves the right to recover full costs in order to return the vehicle to the state in which it was handed over. The vehicle must be returned with a full tank of diesel fuel. Failure to do this may result in a charge of up to £100.
Late return: If you are late returning, Flegg Motorhome Hire must be advised immediately. Failure to advise may result in prosecution for driving whilst uninsured. An additional charge of £50.00 per hour or part thereof will be payable for all late returns, late return exceeding 2 hours will be charged at one day’s rental cost regardless of the circumstances. The hirer will be charged for any additional costs incurred by Flegg Motorhome Hire e.g. lost hire for the next hirer. Out of hours’ collection and return service is available by prior agreement.
Insurance is valid only for the hire period stated in the Rental Agreement and therefore the driving of the vehicle after the contract period may result in the driver committing a traffic offence. This means the hirer is entirely responsible for any accident damage, injury or consequential loss after the expiry of the hire period. The hirer is responsible to ensure that the total number of persons to be carried does not exceed the berth limit and all passengers are wearing seat belts while the motorhome is in motion. Fully Comprehensive insurance is provided by Flegg Motorhome Hire to the driver(s) named on the Rental Agreement subject to the conditions below:
The Insured Vehicle shall not be let out on hire to or be driven by:
Hirers under 21 or over 75 years of age unless otherwise agreed by the Insurer.
Hirers aged 21 or over unless a full valid UK/EU driving license has been held for 24 months.
Persons who have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving license endorsed or suspended or penalty points imposed. Parking and not more than two speeding offences in the past 3 years may be ignored. “Spent” convictions, covered by the Rehabilitation of Offenders Act 1974 may be disregarded.
Persons who have had their license revoked by DVLA on medical grounds or convictions.
Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer.
Drivers who are engaged wholly or partly in professional entertainment or professional sports persons.
Drivers who are Jockeys and persons connected with racing, gaming industry or press of any sort.
Undergraduates and/or students under 25 years of age.
Foreign Service Personnel other than persons holding a full UK/EU licence for two years or more.
Additional insurance charges may apply if the hirer has an occupation that is deemed to be high risk. The Vehicle is insured for damage to the Vehicle and the property of a third party; but does not include any personal insurance for the customer (including death or bodily injury to the driver) or cover any personal possessions. The hire rate quoted includes a standard excess of £500.00 per incident whilst in the UK for UK license holders. An excess of £750 for non-UK license holders and for festivals and sports events. In the event of any damage to either the vehicle or third party property, the hirer will be liable for the first excess. The hirer will also be fully liable for all overhead damage above six feet, (1.83 meters), any damage deemed as negligence and replacement or repair of windows and windscreens, wheels, wheel trims, wing mirrors, roof lights and tyres and or any third-party vehicles or property.
Driving by an unauthorized driver invalidates insurance. It is a criminal offence to drive without insurance in the UK and Ireland. Failure to declare an accident is a criminal offence.
The theft of a Flegg Motorhome Hire vehicle will not be covered by insurance if the ignition keys are left in or on the vehicle whilst unoccupied and the hirer shall be held fully responsible for a replacement vehicle.
Insurance does not cover or include the hirers’ personal belongings.
No other hire insurance is acceptable for the rental of a Flegg Motorhome Hire vehicle.
7. INSURANCE SECURITY DAMAGE DEPOSIT (SDD)
There is a refundable £500 or £750 or £1000 Security Damage Deposit payable by bank transfer. This is fully refundable within three working days of return of the motorhome to the agreed location, on the agreed date and time providing the motorhome is in the same condition as it was let out. This means with the toilet and grey water tank empty and flushed through, the interior clean including all cooking appliances and the fuel tank completely full and one full and one partly full gas cylinder.
Flegg Motorhome Hire reserves the right to increase the SDD for specific events e.g. sporting events and festivals to £750.00.
This SDD will be used to fund any loss or damage to equipment, fixtures, fittings, windows, wing mirrors, tyres or negligent damage to the vehicle.
The hirer agrees to pay Flegg Motorhome Hire any additional costs over and above the SDD value should damages exceed the SDD value.
A cleaning fee of £100 will be charged against the SDD if the vehicle is not returned with the interior in a clean condition.
An additional fee of £50 will be charged against the SDD if the toilet is not returned empty and flushed through. An additional charge of £20 if the grey waste tank not empty and flushed through prior to the return of the vehicle. An additional charge of £70 will be charged for every gas bottle not returned. An additional charge of £30 if one full and one part full gas bottle is not returned.
There are no toilet cleaning facilities at Flegg Motorhome Hire so toilets and waste tanks must be cleaned prior to returning the motor home.
8. INSURANCE EXTRAS
Additional driver with a UK or non-UK license: £30.00 per hire. Maximum two drivers.
Points on license: Drivers with between 4 and 6 points incur an additional insurance cost of £5 per day. Convictions with the following codes may not get cover AC, BA, CD, DD, DR, MS, TT, UT and IN. Please check with Flegg Motorhome Hire if you wish to insure a driver who has any of these endorsement codes on their license even if you think they have expired.
9. PERSONAL EFFECTS TRAVEL INSURANCE/COLLISION DAMAGE WAIVER (CDW). The hirer is encouraged to arrange their own Personal Effects and Travel Insurance and/or CDW. License holders from outside the UK have an additional mandatory excess of £250.
10. UK TRAVEL
Our motorhomes are not to be taken outside of the UK.
In the event of breakdown or accident Auto Legal Protection Services Limited (ALPS), Roadside Assistance are at full disposal of the hirer (number found in welcome pack). Instructions for repair or replacement at a cost not exceeding £100 may be given by the hirer who will be reimbursed on the production of valid receipts at completion of the hire. Flegg Motorhome Hire’s approval must be obtained by telephone on 07958787217 for repairs in excess of this amount. Flegg Motorhome Hire will not be responsible for hotel or any other expenses subsequent to the breakdown but will refund the hire charge for any complete days lost of use of the motorhome. Flegg Motorhome Hire will not be under any liability for third party claims or damages with any accident or breakdown. The hirer must obtain names and addresses of all third parties and witnesses and report the accident to the nearest police station. In the event of an accident involving the vehicle the hirer shall notify Flegg Motorhome Hire by telephone immediately after the accident or as soon as practicably possible. Flegg Motorhome Hire will accept no responsibility for any loss, damage or expense which occurs as a result of any defect or breakdown unless it is due to a proven reason of their failure to adequately maintain the motorhome in a fit state and condition. The hirer will make every effort to assist Flegg Motorhome Hire in handling any claim arising, including providing all relevant information and attending Court to give evidence. The hirer will pay for any costs relating to the delivery of a change over vehicle as a result of an accident regardless of which party is at fault. No SDD or insurance excess will be refunded until any claim is settled.
12. PETS.The acceptance of pets in the motor home is not allowed unless previously agreed by Flegg Motorhome Hire. The specified pet must be well behaved and pet bedding is supplied by the hirer. Pets are not allowed on the seats and must never be left unattended in the vehicle. Any cleaning needed to be done due to pet hairs or soiling will be charged to the hirer. Flegg Motorhome Hire will not be held responsible for the welfare of any pets. The hirer is liable for accidents caused by pets. Pets taken without permission will incur a £150 charge.
13. SMOKING in the motor home is not allowed; any violation will incur a cleaning cost of £120.
14. CARE AND CUSTODY OF THE MOTORHOME
*The vehicle must only be driven by the named driver(s) during the hire period.
*The vehicle must be driven in a safe manner which will not cause damage to people or other vehicles.
*The hirer is liable for any damage, fault or loss to or in the vehicle or fixtures and fitting as a result of the hirer’s neglect or misuse of the vehicle.
*The Maximum number of persons carried in the vehicle shall be no more than the seat belts which must be used while the vehicle is in motion.
*The vehicle must not be driven in prohibited areas and must not be taken off the British Isles without prior consent.
*The hirer shall not use the vehicle for racing or any other activity other than social or domestic purposes and shall not carry passengers in the motorhome for hire and reward.
*The hirer must not pass possession or custody of the vehicle to any persons and the vehicle must be locked at all times when unattended. The keys must not be left in the ignition. No claims by the hirer will be considered in respect of any loss or damage to personal belongings of effect of the hirer of any person or persons.
*The vehicle must not be driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law.
*The vehicle must not be driven by anyone who is not authorized by law to drive the Vehicle.
*The vehicle must not be submerged in water or have contact with Salt Water.
*The vehicle must not be used to carry volatile liquids, gases, explosives or other corrosive or inflammable material other than fuel or cooking gas.
*The vehicle must not be used to attend a festival or major sporting event without notifying Flegg Motorhome Hire
*The vehicle must not be driven on any road surfaces other than on asphalt roads or suitable caravan or campsites.
*The vehicle must not be used in breach of the hirer’s agreement under these terms and conditions.
15. MOTORHOME USE
Flegg Motorhome Hire will carry out a thorough pre-check-out inspection on the motorhome before the commencement of hire. Every system on board the vehicle will be checked and tested to ensure correct operating. The hirer will be given a comprehensive hand-over to ensure he/she knows how everything works. There is also a full manual containing all systems in the vehicle. Should an onboard system fail during your hire, Flegg Motorhome Hire will make every effort to remedy the fault whilst you are away but in some circumstances this may not be possible Flegg Motorhome Hire cannot be held responsible and will not refund any monies should a loss of service be encountered.
No alterations or additions to the Vehicle should be made without the prior written consent of Flegg Motorhome Hire.
16. ROAD TRAFFIC OFFENCES/FINES
All fines incurred by the hirer for infringements of traffic laws or regulations and tolls/charges are the responsibility of the hirer and must be settled by the hirer. The hirer agrees to reimburse Flegg Motorhome Hire in respect of any costs incurred by Flegg Motorhome Hire in recovery of such fines and penalties from the hirer.
Flegg Motorhome Hire will contact the customer after the rental agreement finishes if any traffic offences/infringements are presented to Flegg Motorhome Hire for your hire period. Flegg Motorhome Hire will notify the driver(s) of any speeding or parking fines and there will be an administration charge of £30 for each infringement incurred throughout the hire period.
17. EXCLUSIONS AND LIABILITIES
Flegg Motorhome Hire shall not under any circumstances be liable to make any payments to the hirer in respect of, or to indemnify the hirer against loss, injury or damage sustained by the hirer or any third party as a result of the presence or use of the motorhome or as a result of any defect therein Flegg Motorhome Hire takes no responsibility for any delay, loss, damage or injury that a hirer might experience no matter how it is caused or by whom. In taking delivery of the vehicle the hirer shall be deemed to have satisfied himself that it is in all respects road worthy and in proper and safe condition.
18. CANCELLATION BY HIRER
Cancellation any time after the booking is made means the Booking Deposit will be forfeited.
Cancellation must be in writing (email or letter).
- More than 8 weeks prior to hire period: 20% of total hire charge
- 8 weeks to 3 weeks prior to hire period: 50% of total hire charge
- 3 weeks prior to hire period to no show: 100% of total hire charge
Charges are non-refundable. Cancellation administration fee of £45 will be charged.
Hirers are strongly advised to take out insurance against unavoidable cancellations.
19. CANCELLATION BY FLEGG MOTORHOME HIRE
Sometimes due to unforeseen circumstances (crash, theft, etc.) Flegg Motorhome Hire are unable to supply the vehicle requested and may cancel a hire before or at the proposed commencement, or for reasons as follows:
Named driving licenses are not produced or is invalid in accordance with stated conditions. No refund given.
Failure to provide funds for the Damage Deposit. No refund given.
Failure to provide the stated documentation required. No refund given.
Over occupancy of vehicle in accordance with the provision of seat belts. No refund given.
Failure of non-UK drivers to provide a valid passport and driving license as proof of ID. No refund given.
Motorhome not available due to circumstances beyond our control. Full refund.
No compensation available for additional arrangements booked by hirer (e.g. flights, event tickets etc.)
Flegg Motorhome Hire reserve the right to refuse to hire to any person, without stating cause.
Hirers are strongly advised to take out insurance against unavoidable cancellations.
20. RIGHT TO CHANGE OF VEHICLE
Every effort will be made by Flegg Motorhome Hire to ensure you receive the motorhome ordered. However, Flegg Motorhome Hire reserves the right to change your motor home type in the event of an operational issue. A full refund will be offered if the alternative motor home is not acceptable.
- CONDITIONS OF HIRE
This rental agreement is the sole contract for hiring the motorhome between Flegg Motorhome Hire and the hirer(s), driver(s) and/or passenger(s).
These conditions cannot be varied or altered or waived by anyone providing services or facilities.
Flegg Motorhome Hire cannot be bound by any representative or statement unless it is confirmed in writing by Flegg Motorhome Hire.
Please let us know about any faults or complaints on 07958787217, immediately or as soon as possible. In the event that a complaint is not satisfactorily resolved upon return, the hirer must inform Flegg Motorhome Hire in writing within 14 working days. We hope to resolve complaints within 30 days. We take all complaints and feedback seriously in which in improve the services offered to future customers.
23. DATA PROTECTION ACT
The information that you have provided to Flegg Motorhome Hire will be used to fulfil this contract placed with us. We will not pass this information onto any other organisation outside this company other than to our insurer unless you break the agreement with Flegg Motorhome Hire. In this case, we reserve the right to pass the information you have provided to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. Flegg Motorhome Hire can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose stated in the Data Protection Act 1998
